um marco, duas correntes em disputa

As discussões sobre o poder executivo prerrogativo nos Estados Unidos remontam tanto aos debates fundacionais da Constituição americana, da separação de poderes e da contribuição do conceito advindo de John Locke quanto à expansão e utilização desse poder pelos presidentes em momentos de emergência. O marco do atentado às Torres Gêmeas, no entanto, trouxe um novo impulso a essas discussões, dada a extensão de poderes concedida ao executivo após o acontecimento e sua utilização intensiva ao nível doméstico. Este trabalho pretende apresentar sumariamente modelos analíticos da prerrogativa pré e pós 11 de setembro, por meio de duas linhas em franco e direto embate. De um lado, a vertente extralegal ou extraconstitucional lockeana e, de outro, a de seus críticos.
